Legalising Co-Working Spaces to Boost Startups & Small Businesses in Delhi

Move aims to plug gap in Capital’s startup ecosystem.

Currently, co-working spaces in Delhi operate largely informally without a specific legal framework recognising them as a distinct category of business premises. As a result, small enterprises, startups, freelancers, and property owners face regulatory and operational ambiguity, pushing some ventures to relocate to neighboring cities like Noida and Gurgaon where flexible workspaces are better integrated.

Policy Objective

To formalize and legalize co-working spaces across the National Capital Territory of Delhi with the following goals:

  • Enhance availability and affordability of flexible workspaces for startups and small businesses.

  • Unlock unused real estate by allowing property owners to lease or rent premises (including cafes and underutilized units) as co-working spaces with flexible hours.

Key Policy Provisions

A. Legal Recognition of Co-Working Spaces

  • Define co-working spaces as a recognized category of commercial workspace under the Delhi Shops & Establishments Act or relevant urban land use regulations.

  • Provide clear guidelines for licensing, zoning, and classification of shared workplaces to avoid ambiguity in local enforcement.

B. Flexible Operating Permissions

  • Permit flexible usage (e.g., hourly, daily bookings) across designated properties, reducing the need for traditional long-term leases.

  • Allow 24x7 operations where appropriate, increasing utility for freelancers and startups.

C. Simplified Leasing & Registration Framework

  • Enable government agencies and private owners to lease/lease units as co-working spaces via streamlined processes with minimal paperwork.

  • Explore single-window clearances for co-working space registrations, building permits, and safety licensing (similar to reforms for trade license/property tax).

D. Public Listing & Platform

  • Develop a searchable government-verified registry of legal co-working spaces to help startups locate suitable options by budget, location, and amenities.

  • Activates under-utilised real estate (offices, cafes, commercial buildings), converting them into productive hubs.

  • Encourages extended economic activity beyond standard business hours, supporting local services (cafes, transport, hospitality).

C. Inclusivity & Flexibility

  • Creates affordable workspace options for freelancers, solo entrepreneurs, and micro-enterprises, broadening entrepreneurial participation.

This initiative supports Delhi’s Startup Policy 2025 by facilitating infrastructure needs particularly affordable and flexible workspaces which are central to nurturing the entrepreneurial ecosystem. The policy can strengthen Delhi’s position as a competitive startup hub compared to neighboring states. The policy also places strong emphasis on co-working spaces as a key enabler of entrepreneurship. It states that the Government of NCT of Delhi will provide state-of-the-art infrastructure and support systems to strengthen the entrepreneurial ecosystem across Delhi. Under a private-led model, the government will support incubation centres, fabrication labs, and co-working spaces by offering capital and operational subsidies. These incentives will remain available for the first five years to help recognised startups access such facilities at subsidised rates, in addition to the support already available through Central Government schemes.

Legalising co-working spaces in Delhi addresses key gaps in the startup ecosystem, enhances affordability of workspaces, and leverages idle real estate for economic activity. With clear regulation, streamlined processes, and supportive incentives, this policy can drive innovation, employment, and small business growth in the capital.
